जनआन्दोलन-२ पछिको संक्रमण कालमा हुने गरेका अस्तव्यस्तता र अराजकताका समाचारहरु बीच आज राति पनि एउटा त्यस्तै खबर आएको छ। अहिले नयाँ बानेश्वर क्षेत्रमा निकै तनाव रहेको छ। प्रहरी र आक्रोशित भीडबीच भिडन्त भइरहेको छ। भएछ के भने अघि साँझ ६ बजेतिर काठमाडौंबाट भक्तपुरतर्फ गइरहेको यात्रुवाहक बसले एक साइकल चालक देवीबहादुर खत्रीलाई किचेछ।
त्यतातिरका मान्छेहरुले दावी गरे अनुसार, ठक्कर दिएपछि ढलेका खत्रीलाई बसले ब्याक गरेर फेरि किचिदिएछ। हुन पनि हाम्रो देशको यातायात कानुनले के व्यवस्था गरेको हो कुन्नि, यस्तो समाचार बारम्बार सुनिन्छ। घाइते भयो भने जिन्दगीभर उपचार खर्च व्यहोर्नु पर्छ। बरु मर्यो भने १५-२० हजार कि कति हो तिरे टण्टा साफ हुन्छ। अनि किन ब्याक गरेर नकिच्नु त।
ती पैदल यात्रुलाई अस्पतालतिर लाँदालाँदै बाटैमा ७ बजेतिर मृत्यु भएछ। अनि त के छ र, भीड त्यसै पनि आक्रोशित भइहाल्छ। त्यसमाथि केही अराजक तत्व नघुसेका होलान् भन्न सकिन्न। अनि त त्यही, अराजकता। बा १ ख ३४२१ नम्बरको त्यो बस जलाइदिएछ। आठ बजेसम्म गाडी जलिरहेको थियो। दमकल बोलाइएको थियो। भिडन्त जारी थियो।
अब भोलि यसैलाई निहुँ बनाउँदै यातायात व्यवसायीहरुले चक्काजाम गर्ने हुन् कि ? के भर र ! यस्तै छ साथी, यहाँको कुरा। त्यसैले त मैले भनेको देशै गाइजात्रामय भएको बेला के गाइजात्राका समाचार भन्दै झुक्याएर नभएका कुरा लेख्नु भनेर।
आशा गरौं, लोकतान्त्रिक सरकारले वा सदनले महिला अधिकारदेखि संसदमा चुरोट खान नपाउनेसम्मका विधेयक पारित गरेको जस्तै त्यो ज्यानमारा कानुनलाई पनि परिवर्तन गरोस्।

Solution for this case is amendment in the existing law and life in prison for that particular driver on the charge of first degree murder.Harsh punishment should serve a good lesson for future reckless drivers.

An important issue u have raised. Such incidents have been in news quite frequently. Someday, some law-makers’ or the politicians’s dearest ones should get victimised in the similar ways, then only some initiations will be taken.
Why can’t the representatives raise such issues in the house? The answer is simple, coz they have never been a part of it, thats all.

It is indeed a very sad news and the LAW is very stupid. The law must be changed for good so that these incidents does not happen again.
In the recent news, I think nepali people are becoming more democratic and taking all LAWs in their own hand. Democracy is a group of people doing anything they like …. Even the crime is made, it is the first right of people to inform the police and let them take proper action. This type of action will give the bad people a chance to do bad things.

According to the Manu-Samhita(one of the vedic scripture) says that moderer should be given death sentence.These rascals politicians never will understand it, may be Maoist will do smth.
If we really want to have change in Nepal, Maoist should rule the country, and other so called parties should remain oposition.

Bus and truck drivers never pay attention to smaller vehicles. I feel very unsecured when a truck approaches my car. In Japan, Trucks are considered as recklessly driven vehicle, and they are in fact the major cause of road accidents. One day my wife had almost made accident when a truck in the HIGHWAY approaced from the rear to change lane to the right side. She speeded up the car, but the truck which changed the lane just overdrove us. After a few minutes, we saw that road was blocked because the same truck seemed to have hit a car in front of it. God saved, “Kehi Apriya Ghatana Ghatna payenachha”, except a major damage in the rear part of the car.
Guys, be careful when you drive and walk through the zebracross in Nepal. We do not have any traffic rule and lights.

We can hear about such news very frequently. Everyone knows. But who has amended the law for such incidences? Just a penny (NRS.15,000) for such deliberate actions? There is no price for hunam life. Such culprits should be given full punishment as murderer. To amend, there should be an accident where Mantri or High-rank police Officer or distinguished people should be hit and killed by reversing the vehicle in the same way the driver did for Mr. Khatri. I should not say so, but such incidence then amend the Law otherwise the value of public will never be deemed.

This is really a pity situation of this country’s driving and load related laws. All driven by money ….what do you say? So, people will be ready to kill for maney …as simple as that. This kind of events are not new in Nepal but what the hell these so called ‘authorities’ are waiting for?

I think there is a bit of confusion here. What happened last night was first an accident, then a murder. If the person had died on the first hit the driver could’ve gotton away by paying few thousand rupees. But when he backed the truck and killed – it was done so with an ‘intention to kill’ – and so it is murder, not an accident and the driver can’t be charged for ‘accident’ but for ‘murder’. I guess it all will depend on how the lawyers put forth their cases. Forensics in Nepal might not be as modern as in other developed nations but I’m sure they can differentiate an accident and intentional murder.
If the law is faulty, then people should go knock the doors at the supreme court demanding a change – not creating anarchy on the streets. When the monarchists said we Nepalese weren’t ready for democracy it sounded so hilarious, but now the people are hell-bent on proving those monarchists right.
Talking of ‘accidental death’ there are countries where drivers pay even less (comparitive to GNP, not actual currency value) if they hit someone on the streets where and when pedestrians are not supposed to be walking. Such laws are not meant to protect the drivers but to maintain law and order among pedestrians. Look at our streets – Cows, dogs, cricket stumps, pot holes, chicken… you can find anything you can imagine.

उमेश जी , समस्या त्यती कानुन सँशोधनले मात्र सकिन्न त्यो कानुन सँबैधानिक राजतन्त्र भनिने राजतन्त्रात्मक संबिधानले बनाएको कालो कानुन हो त्यसलाई त सुधार गर्नु पर्छ नै साथै सडकमा सबारी ब्यावस्थापन अनि पैदल यात्री , साईकल यात्री आदिको पनि हिंड्ने निस्चित बाटो बनाउनु पर्छ ता कि त्यस्तो किसिम को दुर्घटना नै हत्पति हुन नपओस ।

यो कस्तो कानुन्? मोर्यो भने १५-२० हजार मात्र? मान्छे को ज्यान को मुल्य त्यति मात्र? उस्का बाबा, आमा ले ख्वाइ पीयाइ पढाइ लेखाइ तेत्रो बनाएको त्यसैको लागी होइन नि ।

Umesh Ji, you are right. I used have a truck business long time ago in Nepal.One day my driver hit two people same time, one died on the spot and other one injured so we took him to the hospital.One who died by the rules we had to pay his family 10,000 Rupees but who was in hospital we spend almost 50,000 for his care and family. The driver never been in police custody and never went to jail for a second.

Jahile pani kunai sabari sadhan le thakkar diyeko ra pachhi back garera kichera mareko khabar suninchha, yo ta ati bhayo ba. Tyasto driver lai jyanmara abhiyog launu parchha. Kanun ma truti chha, turunta sudharinu paryo. Manchhe ko jyan bhanda thulo kehi chhaina, bidesh ma manchhe ko jyan ko surakchhya ko lagi kanun kada bhanda kada ra sabai tarika haru apanayiyeko hunchha. Hamro desh ma manchhe marera umkana pani kya sajilo.
Yadi accident ma koi ghaite hunchha bhane, tyo ghaite lai upachar garne kharchha, driver le garnu parne hunuhundaina, bichara tyati paisa bhako bhaye kina driver hunthyo ra, tyasaile yatayat samtha le jimma linu parchha.

we have had seen many proclamations hardly some of them are implemented has been seen so far. We have no respect for law so we have got this kind of bad hit. Therefore, we first have to be a respobsible citizen of the nation where we can fight for corruption we don’t hesistate to give bribes than opposing for it.
I have doubt that we will have a day where we nepalese have own dicision capacity. Like girija he has not got his own decision ability thats why he happily invites contradictory situations and ciritisim.

लोकतन्त्र को नाममा छाडापन,
एक त कानुन नै यस्तो छ कि कानुनि उपचार तिर लाग्यो भने पैसा पनि खतम , समय पनि बरबाद । हो यो बर्सौ बर्सको बिकृति एकैचोटि छताछुल्ल भएको हो । यसमा घुस्पैठ त सामान्य भै नै हाल्छ तर सत्य चाहि के हो भने यो सबै हाम्रो ब्यवस्थाको कमि कम्जोरि नै हो । मेरो बिचारमा जे लाइ पनि घुसपैठ सङ जोड्न ठिक हुदैन होला ।
सत्य के हो भने नेपालमा सोझा साझाले कानुन पालना गर्न पर्ने, ठुला ठाला भन्नेले कानुन पालना गर्न नपर्ने । जे मा पनि ढिला सुस्ति, बिकृति, छाडापन – यो हामि नेपालिको बर्सौ बर्शको कमाइ हो । के गर्ने सत्य तितै हुन्छ ।

That is a stupid law. Never heard anywhere. There should be strict law on this kind of thing. I would say if the driver is seen doing this and there is enough proof to prove that he should be thrown to jail for life. Poor guy, God help his soul
